The Value of Confidentiality in Digital Asset Transactions

Digital Assets are the most valuable assets. I have been in a debate on Twitter. One side says it hurts domain transactions that so many domain name deals are under confidentiality with regards to price. I respectfully disagree with this very strongly, and it has never affected my ability to negotiate major deals. Many asset classes are transacted under NDA. As a matter of fact, I would say 95% of the buyers and sellers I have worked with over 23 years require confidentiality.

The other side said, “but home sales are reported.” Homes are not intangible assets. A home has a town/city, square feet, a certain number of rooms, and limited (but the best) utility. So many differences. What makes domains a magical asset is the wild card. Domain x may be worth $10k to company A and $100m to company B. I advise many, and they all know that confidentiality is essential and that we protect that in an important sale or acquisition. Many important assets (including most M&A) are confidential. It’s about the buyer and seller. Period.
